Article 601 Criminal Code – Human Trafficking
A sentence of eight to twenty years’ imprisonment shall be imposed on any person who recruits, introduces into the territory of the State, transfers outside the territory of the State, transports, gives authority over, harbors one or more persons who are in the conditions referred to in Article 600, or, carries out the same conduct on one or more persons, by means of deceit, violence, threat, abuse of authority or taking advantage of a situation of vulnerability, of physical or mental inferiority or of necessity, or by promising or giving money or other advantages to the person having authority over them, in order to induce or compel them to work, to engage in sexual or begging activities or in any case to engage in illegal activities involving their exploitation or to submit to the removal of organs.
The same punishment shall apply to anyone who, also outside the modalities set out in the first paragraph, engages in the conduct referred to therein against a person under the age of 18.
The punishment for the master or officer of the national or foreign ship, who commits any of the acts provided for in the first or second subsection or is complicit in them, shall be increased by up to one third.
The member of the crew of a national or foreign ship destined, prior to departure or in the course of navigation, to be trafficked shall be punished, even if he has not committed any of the acts provided for in the first or second paragraph or of trading in slaves, with imprisonment from three to ten years.
Criminalization of trafficking victims:
No, victims of trafficking are not criminalized. The law protects them. Victims of trafficking can be granted a special residence permit for social protection’s reasons in order to facilitate victims in escaping the violence (Article 18 Testo Unico sull’Immigrazione).
